Host Clation provides web hosting to clients worldwide, and we have a responsibility to protect each client and to provide the best services available. All clients of Host Clation are subject to the following terms of service:
This Host Clation Terms Of Service agreement (hereafter referred to as the "TOS") lays down the terms and conditions by which Host Clation's Hosting Services (hereafter referred to as the "Services") will be provided to you upon registration. This TOS is not exhaustive and Host Clation reserves the right to modify it from time to time, effective when notification is posted at www.hostclation.com. No verbal or written agreement/statement by any Host Clation employee or at Host Clation's website will take precedence over the TOS. On registering for and using any Services provided by Host Clation, you the Customer agree to all the terms and conditions of the TOS, as modified from time to time, in its entirety. If Customer resells/represent the Services he or she is paying for, the Customer will be responsible for his or her Clients. Host Clation only recognizes the Customer who is paying for the Services and not his or her clients. Violation of the TOS or any such action that Host Clation deems inappropriate may result in the termination or suspension of the Services for the Customer.
Host Clation reserves the right to intervene with any of the sites hosted on its servers in the interest of its customers. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party Copyright infringement any defective products sold to customer from Host Clation's server. Host Clation shall be the sole judge of what violates this Policy.
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under. If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times. If you have a domain name registered with HostClation, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. HostClation is not responsible for a lapsed registration due to outdated contact information being associated with the domain. If you need to verify or change this information, you should contact our sales team via email/sales phone number. Providing false contact information of any kind may result in the termination of your account. Any high risk transactions, it will be necessary to provide government issued identification/utility bill scan copy and possibly a scan of the credit card used for the purchase. If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied.
Our transfers team will make every effort to help you move your site to us, however, we cannot make guarantees of the transfer process. We provide this as a courtesy service and cannot make guarantees regarding its availability or the amount of time it may take as each host is configured a little differently. We will try our best; however, in some cases we may be unable to assist you in a transfer of data from an old host.
The free transfer services are available for 03 (three) days from your sign up date. Transfers outside of the 03 (three) day free period will incur a charge; for shared/reseller/ first twenty (20) end user account of his/her old host will transfer free of cost and for additional each account it'll cost 500 BDT or 5 USD and also shared hosting each account it'll cost 500 BDT or 5 USD
30 Day Money back Guarantee valid only for Web Hosting service. Money back Guarantee not applicable for domain registration/VPS servers/Dedicated servers. If for any reason you are unhappy with the services you receive from Host Clation during the first 30 days of service (Only Web Hosting), you may request in writing via email or by our cancellation form (as mentioned below) that your services be discontinued at which time you will get receive a full refund. Note that, If client violated the terms and conditions, copyright claim, abuse, phishing report and suspended in that case refund will not be offered also if He/She asked for cancellation and then agreed to continue using services can't ask second time for refund. Clients eligible for 30 Days Money Back Guarantee with her payment method that he/she used for used for pay our bill without (Bkash/DBBL Mobile Banking). Client who pay us via Bkash/DBBL Mobiel Banking, he will get money refund via her own Bank Account (Only BRAC Bank Account). If a shared/reseller hosting account has a past due invoice, we will perform the following actions.
After Billing Period End - Accounts are Auto suspended
7 Days - Late Fee Added 10 %.
45 Days - Accounts will be terminated.
45 Days Later - After Account termination, backup restoration fee 15 USD.
The specific backup policy depends on what type of account you have. We do make daily/weekly backups for all our shared and reseller hosting.
We can restore your web, email and database content from those per your request. However, this is NOT a procedure you should rely on to keep copies of your content safe; we strongly recommend you make your own backups. Our backups are made every week on a random day, and only the newest backups are kept. We make no guarantees about our daily/ weekly backups.
For backups that we do provide, our backups are provided as a courtesy and we do not guarantee our backups. It is recommended that you make your own backups as extra protection.
If your service drops below 99.9% uptime in any given month you will be credited with one free month. This must be claimed within 3 days of our monitoring dropping below this level.
Note that any planned maintenance work is except from this guarantee and will be ignored. VPS servers currently have no SLA.
Uptime level is calculated by our status page and monitors only.
All services provided by Host Clation may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Host Clation and its employees from any claims resulting from the use of the service which damages the subscriber or any other party. Our acceptable use policy is actively and strictly enforced. Offending content or users are suspended from our network, usually as soon as they are discovered, although we will always inform you when and why any action has been taken. Pornography is prohibited on all Host Clation servers. This includes sites that include sexually explicit or hardcore images and/or advertising.
Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.
Subscriber further acknowledges that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
Illegality In any form, including but not limited to the unauthorized distribution or copying of copyrighted software or other data, harassment, fraud, trafficking in obscene material. Undesirable Content Certain types of content are not allowed on our network. We do not host adult content of any description. Content relating to PTC, Hacking, Cracking, Warez and IRC is not allowed. Software, audio and video downloads may only be hosted if you are the writer and copyright owner of the resources or you have a right to distribute the materials. Accounts suspended due to content or AUP violation are not refunded under any circumstances.
Using the Service in a manner intended to abuse or violate the privacy or property rights of others, including but not limited to sending of unsolicited bulk e-mail ("spamming"); this ground for suspension or termination is separate from and in addition to the fees which will result from such activity. You agree to pay a clean up fee of 50$ (USD) per hour if any of our server IP addresses appear on a blacklist as a result of spam from your account.
The following scripts are banned from use on our servers and may not be uploaded or run. Reasons for banning them include adverse effects on server load, invitations to hackers/spammers/criminal activity, etc.

HostClation may terminate your access to the Services, in whole or in part, without notice in the event that: (a) you fail to pay any fees due; (b) your account suspend for (Resource Abuse, phisihing report, spaming etc); (c) you violate this Agreement; (d) your conduct may harm HostClation or others or cause HostClation or others to incur liability, as determined by HostClation in our sole discretion; or (e) as otherwise specified in this Agreement. In such event, HostClation shall not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges accrued prior to the effectiveness of such termination. Additionally, HostClation may charge you for all fees due for the Services for the remaining portion of the then current term.
UPON TERMINATION OF THE SERVICES FOR ANY REASON, USER CONTENT, USER WEBSITES, AND OTHER DATA WILL BE DELETED.
All resellers are strictly prohibited from setting up Free or Trial accounts for their customers. It is also forbidden to use our resources to supply free hosting services.
Free Trials and free accounts (subdomain or otherwise) expose our servers to serve abuse from hackers and spammers. If you are using a reseller plan to offer Free Trial hosting accounts, we will suspend/ terminate your web hosting account, with or without notice. We take this very seriously. There are no exceptions to this rule.
Host Clation shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Host Clation servers going off-line or being unavailable for any reason whatsoever. Furthermore, Host Clation shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Host Clation servers. All damages shall be limited to the immediate termination of service.
Host Clation cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Host Clation are resold. Thus, certain equipment, routing, software, and programming used by Host Clation are not directly owned or written by Host Clation. Moreover, Host Clation holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Host Clation sees fit. FURTHERMORE, Host Clation retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
